Mr. Abhishek Malhotra,
Advocate, TMT Law

Mr. Malhotra is an advocate with 13 years experience. He completed his LL.M. (I.P.) from Franklin Pierce Law Center, USA and LL.B. (Hons.) from National Law School of India University, Bangalore. His primary areas of expertise are intellectual property and ancillary services. Having gained experience as a senior associate with India’s leading boutique IP law firm and an associate partner with a leading Indian general practice firm, Mr. Malhotra offers a rare combination of advisory and dispute resolution services across a wide range of industries.

Mr. Malhotra specialises in prosecution/defence of suits, proceedings and appeals in respect of infringement of intellectual property rights, as well as commercial litigation concerning employment, information technology, and competition issues. He is also adept at drafting and negotiating agreements, especially pertaining to the intellectual property and related fields, including media, information technology, broadcasting, pharmaceuticals. Advising clients across industries, including luxury brands, information technology, media, hardware equipment manufacturing, pharmaceuticals, broadcasting is his forte.

Mr. Malhotra has provided inputs to the Government of India on copyright issues and proposed amendments to the Copyright Act, 1957. He is the guest lecturer at the Indian Institute of Information Technology and also the Chairperson at the INTA Annual Conference on the topic of strategies for brand owners in the BRIC countries (Seattle, 2009).

Mr. Malhotra has spoken at the National Judicial Academy, Bhopal on Enforcement of Trademark Rights – Civil and Criminal Remedies, Indo-America Chambers of Commerce conference on Doing Business in India from an IP perspective, to name a few.

Mr. Malhotra is a regular contributor of papers on the Indian position for various issues pertaining to the music industry for the annual legal publication of the International Association of Entertainment Lawyers (January 2005, January 2007, January 2008); International Trademark Association conference on protection of shapes of goods (Rome, December 2006), and World Intellectual Property Office – FICCI conference on protection of rights of broadcasting organizations (October 2004).

Mr. Malhotra is a member of the Bar Council of Delhi, India, the California State Bar, California, USA, Delhi High Court Bar Association, the International Association of Entertainment Lawyers, the American Bar Association, the International Trademark Association (INTA) and the International Association for the Protection of Intellectual Property (AIPPI).
